Terms of Service

Welcome to NextGens. These Terms of Service govern your access to and use of our website, engineering consultations, and custom software development services. Please read them carefully before engaging with our team.

Effective Date: October 2026 | Last Updated: October 2026

01Acceptance of Terms

By accessing our website, submitting project inquiries, or signing a contract with NextGens, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a corporate entity, you warrant that you possess the legal authority to bind that entity.

02Scope of Development Services

NextGens provides full-stack web engineering, React Native mobile application development, UI/UX design, and custom software architecture solutions. The precise scope, milestones, deliverables, and timelines for any project will be governed by a separate, mutually agreed Statement of Work (SOW) or formal project proposal.

03Intellectual Property & Client Responsibilities

Intellectual Property Rights

Upon final project sign-off and receipt of 100% agreed compensation, ownership of the custom source code and deliverables transfers to the client. NextGens retains the right to showcase completed non-confidential work in our portfolio.

Client Responsibilities

Clients must provide timely feedback, necessary API access, brand assets, and content materials. Delays in client feedback may lead to adjusted delivery timelines and milestone extensions.

04Payment Terms & Milestones

Project pricing and payment terms are outlined in individual project proposals. Typically, projects operate on milestone-based structures (e.g., initial deposit upfront, intermediate milestone payments, and final balance prior to production deployment). Late payments may result in temporary suspension of active development or hosting servers.

05Limitation of Liability

NextGens shall not be held liable for any indirect, incidental, or consequential damages resulting from third-party service interruptions (such as cloud hosting outages, domain registrar failures, or third-party API deprecations). Our total liability shall under no circumstances exceed the total fees paid by the client for the specific project in question.

06Termination of Services

Either party may terminate an agreement with written notice if the other party experiences a material breach of terms. Upon termination, the client shall compensate NextGens for all engineering hours completed and milestones successfully delivered up to the termination date.
